This appeal was adjourned by order of the President dated 15 July 2004 pending the outcome of Case 1025/3/3/04 (CPS Save Activity). Following the handing down of the Tribunal's judgment in that case on 9 December 2004 OFCOM informed the Tribunal that it wished to withdraw the contested notification and OFCOM later issued an announcement on its website to that effect. On 25 May 2005 OFCOM issued a further notification to the appellant.
On 2 August 2005 the appellant informed the Tribunal that it did not wish to appeal against the second notification of 25 May 2005 and applied for permission to withdraw the appeal. On 11 August 2005 the Tribunal made an order granting the appellant permission to withdraw the appeal.
