Summary of appeal published 30 July 2004. The first case management conference was held on 21 Setpember 2004. On 16 November 2004 the Tribunal granted Aquavitae (UK) Limited permission to intervene in an appeal by Albion Water Limited (case no. 1046/2/4/04) involving the same decision against which Aquavitae had appealed in this appeal (see [2004] CAT 19). Aquavitae's appeal has been stayed pending the resolution of case 1046/2/4/04.

A directions hearing took place on 24 October 2006 in case 1031, 1034, 1045 and 1046. A further hearing took place on 20 November 2006. An Order on discontinuance was handed down on 12 January 2007.
