Summary of appeal published on 11 June 2012.

On 6 July 2012 an order was made granting Vodafone Limited permission to intervene and staying the proceeding until 14 days after the Court of Appeal gives judgment in the appeal against the Tribunal's judgment in Cases 1151, 1168 and 1169/3/3/10 ([2011] CAT 24).

On 25 July 2012 the Court of Appeal handed down its judgment ([2012] EWCA Civ 1002) deciding those appeals. On 13 September 2012 an order was made further extending the stay pending determination of an application to the Supreme Court for permission to appeal the Court of Appeal’s judgment. On 12 February 2013, the Supreme Court granted the Appellant permission to appeal the Court of Appeal’s judgment of 25 July 2012.

On 9 July 2014, the Supreme Court handed down its judgment allowing BT's appeal and restoring the Tribunal's judgment of 1 August 2011.

On 9 September 2014 the Tribunal made an order regarding the future conduct of proceedings. By Order dated 6 November 2014 the Tribunal established a confidentiality ring.

By Order dated 4 February 2015, BT was given permission to withdraw its appeal; the main hearing, which had been fixed for 10 March 2015 with a time estimate of 3 days, was vacated.
