The case involves a follow-on claim for damages based on a competition law infringement decision made by Ofcom that Royal Mail had abused its dominant position in the market for bulk mail delivery services in the United Kingdom, contrary to: (i) the Chapter II Prohibition in section 18 of the Competition Act 1998; and (ii) Article 102 of the Treaty on the Functioning of the European Union.
A CMC took place on 21 December 2023. The hearing of the strike-out application made by the Defendants took place on 25 April 2024, and the Tribunal gave its ruling at the hearing. A second CMC was held on 26 April 2024. The issue of what findings are binding in the Ofcom's infringement decision will be heard as a preliminary and the hearing has been listed for 12 June 2024.
A trial of all issues in the claim has been listed to begin on 3 November 2025 with a time estimate of 8 weeks.
