Order of the Court of Appeal refusing Apple's application for permission to appeal the Tribunal's judgment [2024] CAT 58.
Apple had applied for permission to appeal on the following grounds:
1. The Tribunal erred in deciding that there was no conflict of interest within the proposed class; and
2. The Tribunal erred in its assessment of the practicability of opt-in proceedings.
For the reasons set out in the order, the Court of Appeal concluded that the proposed appeal had no prospect of success, there was no error of principle by the CAT and there were no other compelling reasons for the appeal to be heard.
