Summary of appeal published on 23 September 2011. A case management conference took place on 17 October 2011 when each of TalkTalk and BT were granted permission to intervene in the other’s appeal and Sky was granted permission to intervene in the TalkTalk and BT appeal. A hearing took place on Monday 5 December 2011. On 2 November 2011 the Tribunal made an Order referring the specified price control matters arising in the appeal to the Competition Commission for determination. On 11 June 2012, the Competition Commission made its final determination.

Upon BT confirming that it did not intend to challenge the Competition Commission’s determination of the specified price control matters, the Tribunal made an order on 22 June 2012 dismissing BT’s challenge to the WBA Charge Control Decision pursuant to sections 193(6) and 195(2) of the Communications Act 2003.
