On 18 May 2012 an order was made, pursuant to rule 63(3) of the Tribunal’s Rules dealing with service of the claim form on the Third Defendant, which is domiciled outside the jurisdiction. On 29 June 2012 an order was made extending the deadline for filing the First and Second Defendants’ defence. On 18 July 2012 an order was made further extending the deadline for filing the First and Second Defendants’ defence. On 19 July 2012 an order was made extending the deadline for filing the Third Defendant's defence.
On 24 July 2012 an order was made, pursuant to section 16(5) of the Enterprise Act 2002 and rule 48(a) of the Tribunal’s Rules, transferring the claim to the High Court of England and Wales (Chancery Division) with immediate effect.
