1211/3/3/13 British Telecommunications Plc v Office of Communications (Termination charges: NCCNs 1046, 1101 and 1107)

Summary of appeal published on 30 May 2013.

The President made an order on 25 June 2013, on an application by BT and with the support of Ofcom and potential interveners, staying the proceedings until the handing down of the Supreme Court's judgment in case UKSC 2012/0204.

On 9 July 2014, the Supreme Court handed down its judgment allowing BT's appeal and restoring the Tribunal's judgment of 1 August 2011.

BT has indicated to the Tribunal that it intends to pursue its appeal. By an Order dated 8 August 2014, the Tribunal made various directions regarding the future conduct of these proceedings.

A case management conference took place on 30 October 2014. By Orders dated 5 November 2014, the Tribunal gave further directions regarding the conduct of proceedings and the establishment of a confidentiality ring.

On 11 December 2014 the Tribunal made a reasoned order granting TalkTalk Telecom Group PLC permission to intervene and issuing directions in connection with this intervention ([2014] CAT 22). On 24 February 2015, the Tribunal made an Order permitting the withdrawal of the interventions by Vodafone and EE.

A hearing took place on 26 and 27 February 2015. A ruling in respect of matters addressed at that hearing was given on 17 March 2015 ([2015] CAT 6]).

By order dated 20 March 2015 the Chairman gave directions for the future conduct of these proceedings. A hearing was listed for 6 May 2015 with a time estimate of up to three days. By order dated 27 April 2015 the Tribunal permitted BT to withdraw its appeal in these proceedings; the hearing was duly vacated.
