By order dated 24 February 2016 a confidentiality ring was established. Case management directions were given by order dated 25 February 2016.

On 11 and 14 April 2016 the Chairman made orders on disclosure. On 5 May 2016 the Chairman made an order granting BT permission to amend its notice of appeal. On 19 May 2016 the Chairman made a reasoned order granting a short extension of time for filing the Defence and the Reply.

A further case management conference took place on 7 July 2016. Additional case management directions were given by order dated 21 July 2016. The hearing took place from 3 to 14 October 2016. Judgment was handed down on 21 December 2016 ([2016] CAT 25).

On 2 February 2017 the Tribunal made (i) a ruling ([2017] CAT 4) refusing BT’s request for permission to appeal the Tribunal’s judgment of 21 December 2016; and (ii) an order in relation to costs.
