Judgment of the Tribunal on a preliminary issue setting out its reasons for finding that the claimants’ claim for damages under section 47A of the Competition Act 1998 was not time-barred under rule 31(2) of the Tribunal Rules.
The Tribunal unanimously found that the “relevant date” for the purposes of rule 31(2) fell on the expiry of the period during which an appeal against the judgment of the European Court of First Instance in respect of a decision of the European Commission could have been instituted in the European Court of Justice.
