Summary of appeal published on 19 May 2011. On 25 May 2011 the Chairman made an Order establishing a confidentiality ring for the exchange of confidential information between the external and certain internal advisers of all the parties.

A case management conference took place on 13 June 2011, at which the Tribunal made an order regarding the future course of the proceedings. A ruling of the Chairman on the admissibility of certain evidence relied upon by Vodafone Limited was handed down on 17 October 2011.

On 9 February 2012, the Competition Commission published its final determination in relation to the specific price control matters raised in the appeal.

Further case management conferences took place on 10 and 24 February 2012.

The hearing in the matter took place over three days from 3 to 5 April 2012. The Tribunal’s judgment was handed down on 3 May 2012. A reasoned order in respect of EE’s application for permission to appeal was made on 6 June 2012.

On 27 July 2012, the Court of Appeal made an order in respect of EE’s application for permission to appeal. On 4 October 2012 the Court of Appeal made a further order in respect of EE’s application for permission to appeal.

A hearing in respect of costs took place on 21 September 2012.

On 12 November 2012 the Tribunal handed down its ruling on the Competition Commission’s application for its costs.

On 6 March 2013, the Court of Appeal handed down its judgment dismissing EE’s appeal against the Tribunal’s judgment of 3 May 2012 ([2012] CAT 11).
