Status
Application by UK Trucks Claim Limited ("UKTC") to commence collective proceedings under section 47B of the Competition Act 1998 (the "UKTC CPO Application"). The proposed collective proceedings would combine follow-on actions for damages arising from a decision of the European Commission of 19 July 2016 (Case AT.39824 – Trucks).
A case management conference took place on 12 December 2018. The Tribunal directed that the UKTC CPO Application be heard with the CPO application in Case 1289 (RHA) (together, the "CPO Applications").
The deadline for any person with an interest (including any member of the proposed class) to object to either or both of the CPO Applications or the authorisation of either or both of the proposed class representatives and/or to seek permission to make oral observations at the hearing of the CPO Applications was 4pm on 12 April 2019.
A pre-hearing review ("PHR") took place on 8 May 2019. At the PHR the Tribunal decided that the main hearing of the CPO Applications should be adjourned, for reasons given in a written judgment issued on 17 May 2019 ([2019] CAT 15). A preliminary issue in relation to funding arrangements was heard on 4-6 June 2019. Judgment was handed down on 28 October 2019 ([2019] CAT 26). On 17 December 2019 the Tribunal issued a Ruling in relation to DAF's application for permission to appeal against part of the Judgment on the preliminary issue ([2019] CAT 28).
The main hearing of the CPO Applications, which had been re-listed for 13-20 December 2019, was vacated pending the appeal to the Supreme Court in Merricks v Mastercard Inc (Case 1266).
On 17 February 2021, the Tribunal was notified that the name of the First Respondent has changed from Fiat Chrysler Automobiles N.V. to Stellantis N.V..
The main hearing of the CPO Applications took place on 19-21, 26 and 27 April 2021. The Tribunal issued its Judgment on 8 June 2022 ([2022] CAT 25).
On 28 October 2022 the Tribunal issued its ruling ([2022] CAT 48) on several applications for permission to appeal the Tribunal's Judgment of 8 June 2022.
On 10 November 2022 the Tribunal issued its ruling on costs ([2022] CAT 51).
By an Order of the Court of Appeal dated 28 September 2023, certain matters were remitted to the Tribunal. The hearing of those remitted matters has been listed to take place on 4 and 5 June 2024.
