This judgment ruled on a second decision of the OFT in relation to Aberdeen Journals’ alleged predatory pricing in March 2000. The original decision was set aside by the Tribunal who remitted the question of market definition back to the OFT for further consideration. In this judgment, the Tribunal upheld the OFT had not taken sufficient account of the short duration of the infringement.
