Ruling of the Tribunal in which the Tribunal referred to the Competition Commission (pursuant to section 193 of the Communications Act 2003 and Competition Appeal Tribunal (Amendment and Communications Act Appeals) Rules 2004) the specified price control matters raised in the mobile call termination appeals by Hutchison 3G and BT.
The questions referred to the Competition Commission were set out in an annex to the Ruling.
In the Ruling, the Tribunal considered two questions: (i) whether the questions referred should require the Competition Commission to set an alternative price control as part of its determination; and (ii) whether the questions should be worded so as to allow the Competition Commission to determine that the level of the price controls of the mobile network operators could move in one direction only or whether that could move in either direction.
