Ruling of the President (sitting alone) on an application by British Sky Broadcasting Group plc (“Sky”) for disclosure, within a confidentiality ring, of certain material provided to the Competition Commission by ITV plc and its financial advisers during the course of the Competition Commission’s investigation.
In order to deal fairly with Sky’s contention that the Commission could not properly make the findings in relation to its overall conclusions on jurisdiction and effects on competition on the material before it the President ruled that the Tribunal should have sight of the material relied on by the Commission.
