Ruling of the Tribunal following an application by National Grid for permission to appeal the Tribunal’s judgment of 29 April 2009. The Tribunal concluded that none of the grounds of appeal raised an issue which was sufficiently material to the Tribunal’s findings to establish a real prospect of success. There was also no other compelling reason for the matter being considered by the Court of Appeal. Accordingly, the Tribunal ordered that permission to appeal be refused.
