Ruling of the Tribunal refusing the Applicants’ request for permission to appeal from the Tribunal’s judgment of 10 December 2008 ([2008] CAT 36).
The Applicants’ ground of appeal concerned the Tribunal’s finding that the statements by the Prime Minister and the Chancellor of the Exchequer had not fettered the discretion of the Secretary of State in reaching his decision not to refer the HBOS/Lloyds TSB to the Competition Commission.
The Tribunal refused permission to appeal on the basis that the ground of appeal did not disclose a point of law. In any event, the Tribunal held that the point had no real prospect of success and there were no other compelling reasons to allow an appeal to the Court of Session.
