Judgment of the Tribunal on the question of whether the Defendant, NSAR Limited (“NSAR”), is an undertaking for the purpose of section 18 of the Competition Act 1998. By order of 21 July 2016 the President directed that this question be determined as a preliminary issue in these proceedings.
For the reasons given in the Judgment, the Tribunal held that for the purpose of the claim in the present proceedings NSAR constitutes an undertaking and determined the preliminary issue accordingly.
