Ruling of the Tribunal on the Appellants’ application for permission to appeal the Tribunal’s judgment of 6 October 2017 ([2017] CAT 23) unanimously dismissing an appeal brought by the Appellants under section 46 of the Competition Act 1998 (“CA 98”). Permission to appeal has been refused on the basis that none of the grounds has any real prospect of success and there is no other compelling reason for granting permission to appeal. The Tribunal also ruled that the Respondent is entitled to its costs.
