Ruling of the Tribunal on an application by the Claimants for permission to appeal the Tribunal’s judgment refusing applications to extend time to lodge proceedings seeking damages pursuant to section 47A of the Competition Act 1998. The Tribunal held that the Claimants’ grounds had no real prospect of success. On the question whether rule 19 of the Tribunal Rules allowed for an extension of time for lodging a claim brought under section 47A, the Tribunal concluded that although this was a point of law which may have had some chance of success, it should exercise its discretion to refuse permission.
