Further ruling of the Tribunal on an application by the Defendant to strike out sections of the particulars of claim lodged by the Claimant on 18 June 2010. In the absence of agreement by the parties following its earlier ruling (see [2010] CAT 30), the Tribunal ordered that certain paragraphs of the Claimant’s Particulars of Claim be struck out.
The Tribunal also granted an extension of time to the Defendant to appeal against the Tribunal’s decision on exemplary damages and ordered that each side should bear its own costs of the Defendant’s strike out application.
