Ruling of the Tribunal on the Claimant’s application to re-amend the Particulars of Claim and on costs.
In respect of the Claimant’s application for permission to re-amend its Amended Particulars of Claim, the Tribunal granted permission save that it struck out paragraphs 50 and 51 pursuant to rule 40 of the Tribunal’s Rules, and gave permission for the inclusion of paragraphs 70 and 78 only in the forms prescribed by the Tribunal’s Ruling.
In respect of the Claimant’s costs of defending the application for security for costs, which was decided by the Tribunal’s Ruling of 23 April 2012, the Tribunal held that the Claimant was entitled to its reasonable costs. The Defendant was ordered to make an interim payment to the Claimant in the amount of £30,000 in respect of those costs, with the remainder to be assessed. There was no order as to costs in respect of the remaining costs incurred and sought by the Defendant in respect of the other matters determined by the Tribunal’s Ruling of 23 April 2012.
