A further case management conference took place on 23 October 2006 at which BT plc, Cable and Wireless plc, GC Pan European Crossing (UK) Limited, Global Crossing (Europe) Limited, Global Marine Systems Limited, NTL Group Limited and Tyco Telecommunications (US) Inc were granted permission to intervene.

A hearing took place on 14 November 2006 to consider an application for disclosure. A Ruling on disclosure was handed down on 20 November 2006. A further hearing to consider the admissibility of the appeal took place on 30/31 January 2007. On 30 January 2007, a further ruling on disclosure was given. A Judgment on admissibility was handed down on 3 April 2007.
