Ruling on JD Sports' application for specific disclosure. Applying the principles enunciated by the Tribunal in Ecolab v CMA [2020] CAT 4, the Chairman ordered the CMA to disclose to JD Sports certain questionnaire responses it had received from adidas and Nike. The Chairman dismissed part of JD Sports' application which contended that the CMA should be ordered to disclose certain passages of its Final Report without redaction. The CMA had already made extensive disclosure of these passages and the outstanding redactions were few in number and confined to third party identities and source materials.
