Claim for damages for breach of Article 101 of the Treaty on the Functioning of the European Union and Chapter I of the Competition Act 1998 by (1) Vattenfall AB; (2) Vattenfall Eldistribution AB; (3) Vattenfall Vindkraft AB; (7) Västerbergslagens Elnät AB; (8) Thanet Offshore Wind Limited; (10) Ormonde Energy Limited; (11) Vattenfall A/S; (12) Vattenfall Vindkraft A/S; (13) DOTI Deutsche Offshore- Testfeld- und Infrastruktur- GmbH & Co. KG; (14) Stromnetz Berlin GmbH; and (15) NoordzeeWind C.V. (together, the “Claimants”) against (1) Prysmian S.p.A; (2) Prysmian Powerlink S.R.L; (3) Prysmian Cables & Systems Ltd; (4) Prysmian Group Finland OY; (5) Prysmian Kabel und Systeme GmbH; (8) Prysmian Cavi e Sistemi S.r.l; (9) NKT A/S; (10) nkt GmbH; (11) nkt Verwaltungs GmbH; (12) NKT (U.K.) Limited; and (13) NKT (Denmark) A/S; (together, the “Defendants”) The Claimants rely on a decision of the European Commission of 2 April 2014 in Case AT/39610 - Power Cables which was addressed to several of the Defendants.

The Issues in the proceedings were transferred from the High Court to the Tribunal by order of Mr Justice Johnson dated 13 October 2020.

Pursuant to a consent order dated 14 September 2022, the proceedings have been stayed upon the terms set out in a confidential agreement between the Claimants and the Defendants.
