Claim under section 47A of the Competition Act 1998. The Claimant has applied for fast-track designation of the proceedings.

The first case management conference took place on 14 March 2022 at which the Tribunal dismissed the Claimant's application for fast-track designation of the proceedings and made directions for the future conduct of this matter. On 23 May 2022, the Tribunal issued its ruling giving reasons for dismissing the Claimant's fast-track application ([2022] CAT 22). The Tribunal also issued its ruling on 23 May 2022 dismissing the Defendants' objections made at the first case management conference to paragraphs of the Claimant's Reply and annex ([2022] CAT 23).

A further case management conference took place on 5 April 2022 at which the Tribunal heard submissions from the parties on matters relating to costs capping and costs management. On 24 May 2022, the Tribunal issued its ruling dismissing the Claimant's application for an asymmetrical costs capping order and approved costs budgets for the costs management of the proceedings ([2022] CAT 24).

Upon the parties having agreed terms of settlement, the Tribunal made an order on 28 October 2022 that the proceedings be stayed. The adjourned Phase 1 trial relisted for 3-4, 7-8, 11 and 17-18 November 2022, with a time estimate of seven days, has been vacated.
