Judgment of the Tribunal setting out its reasons for granting a Collective Proceedings Order (CPO) in the proceedings. Given the close similarity of the proceedings with the previous Gutmann proceedings (Cases 1304 and 1305), the Respondents, while making clear that they would strongly contest the substantive proceedings, did not seek to oppose the making of a CPO. Nonetheless, the Tribunal noted that it is necessary for the Tribunal to be satisfied that conditions in s. 47B(5) of the Competition Act 1998 are fulfilled. The Tribunal was satisfied that these conditions i.e. the "authorisation" and "eligibility" conditions were fulfilled.
