1599/7/7/23 Doug Taylor Class Representative Limited v Black Horse Limited and Others

Application to commence collective proceedings, under section 47B of the Competition Act 1998 ("the Act"), by Doug Taylor Class Representative Limited against  (1) Black Horse Limited; (2) Black Horse Group Limited; (3) Lloyds Bank Asset Finance Limited; (4) Lloyds Bank PLC; and (5) Lloyds Banking Group PLC (together, “the Proposed Defendants”). 

The claims which the PCR seeks to combine are for loss and damage caused by the Proposed Defendants’ breach of the statutory prohibition under Chapter I of the Act. The Proposed Class Members (“PCMs”) are consumers who funded their acquisition of used motor vehicles in the period from 1 October 2015 to 27 January 2021 using point-of-sale motor vehicle products pursuant to point-of-sale agreements with one or more companies in the Proposed Defendants’ corporate group.

On 5 April 2024, the proposed proceedings were stayed by consent until 25 November 2024.
