Ruling of the Tribunal on the Appellant’s application for permission to appeal the Tribunal’s judgment of 12 November 2019 ([2019] CAT 27) unanimously dismissing the appeal brought by the Appellant under section 46 of the Competition Act 1998. Permission to appeal was refused on the basis that none of the grounds had any real prospect of success and there was no other compelling reason for granting permission to appeal. The Tribunal also ruled that the Intervener was not entitled to its costs.
