Judgment of the Tribunal as to: (i) jurisdiction; (ii) an application by the UK Defendants to strike out the Claim; and (iii) an application by the Defendants that the Tribunal's order for service out of the jurisdiction be set aside due to a material non-disclosure by the Claimants.
For the reasons given in the judgment, the Tribunal unanimously decided:
(i) that the UK is the proper place for the Claim, irrespective of whether the application to strike out the Claim against the UK Defendants succeeds;
(ii) to refuse to strike out the Claim against the UK Defendants; and
(iii) that there was no material non-disclosure by the Claimants, and in any event, if the incorrect information amounts to a material non-disclosure, the order for service out would not be set aside anyway.
