1521/5/7/22 (T) WM Morrison Supermarkets Limited & Others v Volvo Group UK Limited & Others

Claim for damages brought by WM Morrison Supermarkets Limited and four other Claimants in respect of alleged infringements of prohibitions imposed by Article 101 of the Treaty on the Functioning of the European Union, Article 85 of the Treaty Establishing the European Economic Community, Article 81 of the Treaty Establishing the European Community, and section 2 of the Competition Act 1998.

The claim is made against (1) Volvo Group UK Limited; (2) Aktiebolaget Volvo (Publ); (3) DAF Trucks Limited; and (4) DAF Trucks N.V.. the Third and Fourth Defendants have made an Additional Claim under CPR Part 20 seeking an indemnity or alternatively contribution from the following Third Parties: (1) Volvo Lastvagnar AB; (2) Volvo Group Trucks Central Europe GmbH; (3) Renault Trucks SAS; (4) TRATON SE; (5) MAN Truck and Bus SE; (6) MAN Truck and Bus Deutschland GmbH; (7) Daimler AG; (8) Stellantis N.V.; (9) CNH Industrial N.V.; (10) Iveco S.p.A.; (11) Iveco Magirus AG; (12) Scania Aktiebolag (Publ); (13) Scania CV Aktiebolag (Publ); and (14) Scania Deutschland GmbH.

The proceedings were transferred from the High Court to the Tribunal by order of Master Pester dated 16 May 2022.

A joint case management conference in the Trucks Second Wave Proceedings took place in the Court of Session, Edinburgh on 19 and 20 October 2023.
