1361/5/7/20 (T) Enterprise Rent-a-Car UK Limited v DAF Trucks Limited & Others

Claim for damages for breach of Article 101 of the Treaty on the Functioning of the European Union (and/or its earlier equivalents) and/or Chapter I of the Competition Act 1998 by Enterprise Rent-a-Car UK Limited (the "Claimant") against (1) DAF Trucks Limited; (2) DAF Trucks N.V.; (3) DAF Trucks Deutschland GmbH; (4) PACCAR Inc; (5) PACCAR Financial plc; (6) Leyland Trucks Limited; (7) CNH Industrial N.V.; (8) Fiat Chrysler Automobiles N.V.; (9) Iveco Limited; (10) Iveco S.P.A.; and (11) Iveco Magirus AG (the "Defendants"). The Claimant relies on a decision of the European Commission of 19 July 2016 (Case AT.39824 - Trucks) which was addressed to (amongst others) the Second, Third, Fourth, Seventh, Eighth, Tenth and Eleventh Defendants.

The issues in the proceedings were transferred from the High Court to the Tribunal by consent by order of Master Clark dated 6 February 2020.

On 17 February 2021, the Tribunal was notified that the name of the Eighth Defendant has changed from Fiat Chrysler Automobiles N.V. to Stellantis N.V..

A joint case management conference in the Trucks Second Wave Proceedings took place in the Court of Session, Edinburgh on 19 and 20 October 2023.
